EU Schengen Visa is NOT a work permit

There seems to be a lot of confusion as to what the Schengen visa really is.

The Schengen Visa was created by members of the European Union to enable visitors to travel freely between the member states. It has made traveling between its 25 member countries (22 European Union states and 3 non-EU members) a lot easier and contains a lot less red tape. Gone are the days that you had to get a visa for all EU countries you wanted to visit.

When you travel on a Schengen Visa you can travel to any (or all) member countries using one single visa. The Schengen visa is a “visitor visa”. It is issued to citizens of countries who are required to obtain a visa before entering Europe. A Schengen visa allows the holder to travel freely within the Schengen countries for a maximum stay of up to 90 days in a 6 month period.

However, the Schengen visa is NOT a work permit. You can travel on a Schengen visa to go on holiday or on a business trip. It does not allow you to work in the Schengen countries. In order to work in the EU you need a work permit issued by the individual member state.

You can only get a work permit if you qualify based on the criteria defined by the individual member state. The company who wants to employ you needs to apply for the work permit and indicate why they can not find anyone in Europe to fill that position. Only then will a work permit be issued. The chances a company will obtain a work permit are very small as unemployment levels in Europe are very high and countries are trying to ‘protect’ their work force. (Read: protect the votes they would get in an election.)

Once you are lucky enough to obtain a work permit, you are stuck with the company that hired you. If you want to leave the company in order to join another company for a job anywhere in the EU, the whole process starts all over again. Your new employer will need to prove to their government why you deserve a work permit. If they fail to obtain it, you’re on the next plane home.

Some Schengen countries such as Norway, which is not a member of the EU, issue Skilled Jobseeker Residence Permits which allow you to live in Norway for 6 months and search for jobs & interview with employers. As with all work permits, this is limited to a certain period of time and once the period is up you are expected to leave the country again. Note that this is not a Schengen visa.

If you want to qualify you will need a Vocational training/Craft course/University Degree or a higher Special qualification from a Recognised University that meets Norwegian standards and is relevant to the job you are nominated for.

You must also have sufficient funds and medical insurance worth at least €30,000 to live in Norway for the duration of your intended stay. The funds required currently correspond to 107,450 Norwegian Crowns for a period of six months, which is approximately 17,000 US Dollars or 950,000 Indian Rupees.

 

Yahoo boss stumbles over CV

If you thought “dressing up” a CV was only done by unscrupulous people trying to blag their way into a job, think again.

Scott Thomson, the Yahoo CEO, who only got the top job in January this year, had to resign over the weekend after it emerged that he claimed to have earned a computer sciences degree that only started being awarded four years after he had graduated from university. CEO’s are meant to have foresight in order to steer companies, but this seems to have been a little too much foresight.

It shows that you will at some point be caught out when you start claiming things on your CV that are not true. In this internet age, where everything and anything is connected, fibs can be exposed pretty quickly by typing in a few keywords in a search engine.

It really shows that you not only need to create an honest CV, but also that you need to manage your on-line presence. Someone will have probably found out from Scott Thomson’s old university’s website that the degree didn’t exist until four years after he graduated. So check your facts and make sure your dates stack up on your CV.

Recruiters often have a sixth sense when it comes to unearthing lies on CVs. They see so many CVs and interview that many candidates that they will have developed a nose for things that might be not completely the truth and will hone in that during an interview.

Why blow your chances of getting a great new job by adding things that are irrelevant to your achievements? Scott Thomson would most likely have earned the top job at Yahoo anyway without a computer sciences degree, based on his achievements in business until then. Recruiters probably approached him for the Yahoo job based on what he had achieved so far, so a computer sciences degree was probably not that relevant.

So, moral of the story: Don’t lie!

He has a point. The USA is already coming out of the financial crisis, whereas Europe is still diving deeper into the chaos. There is no end in sight to the economic problems we’re in. Not only are politicians squabbling as if Europe has got loads of time to get out of the crisis, the administrative hurdles would be entrepreneurs have to take to set up a new business are so high, many people just give up. That’s not conducive to reviving the European economy….

We can speak from experience. When we tried years ago to get a merchant account (in order to take payments online) through a bank in the UK, and we were asked to come up with business plans, how much we were going to take on a monthly basis, etc. When you’re starting out you don’t have a clue, especially when you’re doing something that hasn’t been done before. (In 1995 a job site was a rather strange kind of business, and it still is according to the banks….)

So, stalemate. We didn’t want to waste time writing business plans that were destined for the bin, so we ended up creating an account with PayPal in less than five minutes. The profit they make on our transactions now benefits the US economy, not the EU.

Over the years we have tried to get a proper merchant account, but we still had to jump through hoops and be very subservient to the banks in the hope of securing one. When you realise that they put you through all this just to handle your own money and that you don’t want to have a credit line with them, you just think ‘What’s the point?’ We also wanted to move away from PayPal as their fraud detection service is pants. We spend more time detecting fraudulent payments than technologically is necessary.

So in the end we have decided to give up on the red tape and make the site pay for itself in a different way that does not involve the nightmare of a merchant account. When in future we might need one we will be forced to move outside the EU and set one up there. Great for the EU economy! Not……

Leaving the UK to move abroad? Don’t forget to tie up those loose ends.

It can be quite a chore trying to understand the tax consequences of leaving the UK. Every year thousands of people leave and most never give much thought to whether they still have obligations to HMRC; worse still, many leave and never reclaim overpaid tax. Here we’ve put together some top tips to help you avoid the most common mistakes:

One of the most common mistakes made by taxpayers leaving the UK is the failure to claim a refund of overpaid tax.

All UK taxpayers (and some non residents) are entitled to a UK Personal Allowance (basically a tax free allowance). For PAYE taxpayers, their personal allowance is split into weekly or monthly amounts and offset against their weekly or monthly wages. A taxpayer who leaves the UK part way through a tax year therefore does not get the full benefit of their personal allowance and in most cases, overpays UK tax.

To reclaim the overpayment a claim must be submitted to HMRC. Many departing taxpayers however are not aware of this and needlessly leave their money with HMRC.  The timeframe for making this claim was 6 years but it is being revised down to 4 years very shortly.

Self–employed (self assessed) taxpayers on the other hand are subject to a different method of tax collection. Rather than the tax being taken via PAYE, they must file a Tax Return annually, declaring their income and working out their tax liability.

The tax itself is paid as follows:

  • 31st Jan – 1st Payment on Account (POA);
  • 31st July – 2nd POA;
  • 31st Jan next – Balancing payment – the difference between the amount paid as POA’s and the final liability becomes due.

A self-assessed taxpayer who leaves the UK part way through the year may therefore have overpaid tax as a result of their POA’s. The POA’s are an estimate of the current year liability based on the prior year. If a trader ceases part way through a year therefore, the POA’s are likely to be excessive.

Any overpaid tax should come out in the wash when the taxpayer files his final Tax Return but it’s important to remember that the Tax Return must be submitted.

This is only relevant to taxpayers leaving the UK and letting their UK property. It is however an immensely common area of confusion.

The term non-resident landlord (NRL) is a misnomer; in reality someone is classified as an NRL if they let UK property and their usual place of abode is outside the UK.

The main consequence of being an NRL is that the tenant or letting agent is legally obliged to deduct basic rate tax (20%) from the rental income and pay it direct to HMRC. The problems with this are two-fold:

  1. As the 20% is deducted from the rents before any allowance is given for tax deductible expenditure (e.g mortgage interest), it will be in excess of the real tax liability.
  2. While this excess can be reclaimed, it will only be received after the Tax Return has been submitted. The result is a loss of cash flow.

The above scenario can be avoided by registering with HMRC’s NRL scheme. Once a taxpayer is registered, the tenant/letting agent is not required to deduct tax at source. The NRL can receive the rental income gross. A word of warning though, while the NRL does allow for gross rent receipt, it does not exempt the income from UK tax and the NRL will need to file a UK Tax Return annually and pay the corresponding UK tax due.

Finally, most countries operate a Residency tax system – this means they levy tax on their residents’ worldwide income. While some countries (notably Hong Kong) operate a Territorial system, the majority are Residency based. As such, a taxpayer departing the UK is likely to be subject to tax in his new home country on his worldwide income – including his UK rental income.

In these scenarios advice should be taken on the specific rules in the foreign jurisdiction but in general there should be some form of double tax relief available in that country for UK tax paid on the UK rental income.

  • Sort out your Bank Accounts

For those UK taxpayers leaving the UK but intending to retain their UK bank accounts, one aspect often overlooked is the fact that it is possible to receive interest without the deduction of tax.

Savers who are ‘not ordinarily resident’ in the UK can complete Form R105 to receive their interest without UK tax taken off. Unfortunately Banks are not required to accept a R105 so not all Banks offer this facility.

As in the case of the UK rental income discussed above, while it may be possible to avoid UK tax, advice should be taken in the foreign jurisdiction to which the taxpayer is emigrating as to the tax status of the UK interest in that country.

  • Pension Issues

The whole area of pensions is highly complex and confusing to many taxpayers and this is not surprising given the number of changes we’ve had since April 2006.

While there are many things we could say about the good and bad of migrating to a QROPS (Qualifying Recognised Overseas Pension Schemes), that would be an article in itself.

Instead we’re just going to focus on the scenario where a UK taxpayer is receiving a UK pension and moves overseas.

As a general rule, non residents of the UK are taxable on their UK source income. That said, many Double Tax Treaties (DTT) specifically address the topic of pensions. Double Tax Treaties do exactly what they say on the tin – they are bilateral agreements between countries which ensure the residents of those countries do not suffer double taxation.

The pension article in most DTTs allocates the taxing rights to the country of residence. A good example is the UK-Australia Treaty.

So as an example, consider a UK taxpayer in receipt of a UK pension who moves permanently to Australia: in the absence of the DTT, the UK pension would be subject to UK PAYE at source. However, because of the terms set out in the UK-Australia DTT, the UK pension is in fact exempt from UK tax but taxable in Australia.

In order to ensure the pension is not subject to UK PAYE the correct form must be completed. The forms are available for download at http://www.hmrc.gov.uk/cnr/app_dtt.htm

A taxpayer who has moved to Australia but has not filled out the correct form is likely to be receiving his pension net of UK Tax through PAYE. As a result, he will have overpaid UK tax. Fortunately a refund can be claimed so all is not lost. The deadline for claiming the refund is 4 years.

Eterna Refinery & Shenzhen Bank Scammers again

Hmm, these scammers keep on trying!

Just received a letter in the snail mail claiming that the Shenzhen Development Bank in China holds the estate of a long lost “relative”. When you read the letter it becomes clear quite rapidly that this is another scam. (Besides a major give away of the letter not being on a Shenzhen Bank letterhead.)

The letter is littered with weird expressions which are clearly not English. It’s probably literally translated from Chinese. “the money has been willed to you” Duh….

This person claims to have the KEY to many millions in the bank, but needs your surname to claim. He offers to go 50/50 on it. And then proceeds to claim that no one is getting hurt…. Yeah right. Wait until they tell you that you have to pay a certain amount to release the funds. Who’s hurting then? You won’t see that money back again. Ever.

Moral of the story: Don’t been too greedy as it will catch up with you.

The other scam the system just removed from the site claimed that the Eterna Refinery in Scotland has a job opportunity. The text then goes on to claim expatriates can work in fields like Engineers. Never knew that being an engineer was a field…. Is it not engineering? They have also gone through your CV/Resume. Huh, I thought this was a job advert? Why do they have to put up a job advert when they have gone through your CV? Sounds like a case of scammers not knowing what they are doing.

Other indicators this is a scam are (again) the weird language used, the long list of unrelated jobs and the fact they use a gmail account rather than a company account.
A quick search on Google reveals that there is no company website any more for the Eterna Refinery. It was probably removed from the servers by the hosting company after a deluge of complaints as it shows in Google that the site once existed.

Anyway, as always, be aware of scams. If in doubt, research the advertiser before you apply. And make sure you do NOT send copies of passports, diplomas, bank account details, etc. Anything that can identify you can be used by scammers to open bank accounts in your name, withdraw funds and leave you with an overdrawn account. Nice huh?

#1: Try Harder
OK, this might sound clichéd, but how do you expect to find jobs unless you go seeking for them? When the economy is down, you can’t expect employers to come behind you with jobs. Now, most people might get the idea that going to job portals, submitting your resume and then waiting patiently for calls to come in is the key to get more exposure and better jobs.

Most of the good jobs are gone before they ever come to the market. The best way to get job interviews even before hundreds of people start applying to the same opening is through your network. Tell your friends, ex-colleagues, and relatives that you are looking for a job. Even though they might not be directly having job opportunities for you, their network might!
